Schrecklich! Traumatisch! Nie wieder!

Sehr geehrte Damen und Herren,
hiermit legen wir eine formelle Beschwerde über den von uns gemieteten Aufenthalt in Ihrem Ferienhaus ein. Die aufgeführten Mängel, Rechtsverstöße und Pflichtverletzungen seitens der Hausbesitzerin haben nicht nur die vertraglich vereinbarte Nutzung des Mietobjekts erheblich beeinträchtigt, sondern auch unsere Sicherheit, Privatsphäre und das Wohlbefinden massiv verletzt. Aufgrund der Schwere dieser Vorfälle fordern wir die vollständige Rückerstattung des Mietpreises oder eine gleichwertige Entschädigung.
1. Vertragsbruch durch defekte Ausstattung
• Die Klimaanlagen in sämtlichen drei Schlafzimmern waren in der ersten Nacht funktionsunfähig.
• Anstatt den Mangel unverzüglich zu beheben, wurden wir durch die Hausbesitzerin beleidigt, angeschrien und der Lüge bezichtigt.
• Erst später stellte sich heraus, dass eine Batterie ausgetauscht werden musste, eine Anlage fehlerhaft programmiert war und eine dritte gänzlich defekt ist. Letztere sollte laut Hausbesitzerin erst nach unserer Abreise repariert werden – ein klarer Verstoß gegen die mietvertraglich zugesicherte Ausstattung.
• Da wir auf eine Lösung bestanden, brachte die Hausbesitzerin schließlich einen Ventilator. Allerdings tat sie dies ebenfalls unangekündigt, indem sie ohne unsere Zustimmung erneut das Haus betrat. Der Ventilator konnte den Mangel nicht ausgleichen, sodass das Zimmer weiterhin faktisch unbrauchbar war.
2. Rechtswidriges Betreten des Hauses
• Die Hausbesitzerin hat das Mietobjekt mehrfach und ohne Ankündigung betreten, auch während unserer Abwesenheit und obwohl sich unsere Wertsachen im Haus befanden.
• Dies stellt einen eindeutigen Eingriff in unser Hausrecht (§ 858 BGB – Verbotene Eigenmacht) und eine schwerwiegende Pflichtverletzung im Rahmen des Mietrechts dar.
